What Do the Intestacy Rules Mean for Your Family?

If you die without a valid will, your estate will be distributed according to the rules of intestacy. These rules are fixed in law and do not take into account your personal wishes, relationships, or family dynamics.

Under the intestacy rules, your spouse or civil partner is usually first in line to inherit. However, the position becomes more complex if you also have children. In many cases, your spouse does not automatically inherit everything, and your estate may be divided between them and your children.

Importantly, unmarried partners, no matter how long the relationship has lasted, are not entitled to inherit under the intestacy rules. Stepchildren and close friends are also excluded.

This can lead to unexpected and sometimes distressing outcomes, particularly for modern families. It may also result in delays and additional legal costs in administering the estate.
